TERMS OF SERVICE

1. Overview

These Terms of Service (“Terms”) govern your use of the website www.willowtreedesign.ca and any services provided by Willow Tree Design Co. (“we,” “us,” or “our”). By accessing this website or working with us, you agree to these Terms.

2. Services

Willow Tree Design Co. provides graphic design, branding, website design, and related creative services.

All services are:

• Defined in a written proposal or agreement
• Subject to scope, timeline, and pricing outlined prior to project start

We reserve the right to refuse service at our discretion.

3. Payments & Deposits

• A non-refundable deposit (typically 50%) is required to begin work
• Final files will not be delivered until full payment is received
• Payment plans may be offered but must be agreed upon in writing

Late payments may result in:

• Project delays
• Additional fees
• Suspension of services

4. Revisions & Scope

Each project includes a defined number of revisions or a reasonable revision process.

Anything outside the agreed scope (including additional concepts, major redesigns, or new deliverables) will be billed at our hourly rate.

5. Client Responsibilities

You agree to:

• Provide timely feedback and content
• Ensure all materials provided (images, logos, text) are legally owned or licensed
• Review and approve work in a timely manner

Delays in communication may affect timelines and delivery.

6. Intellectual Property

• Final deliverables become the client’s property once full payment is received
• Willow Tree Design Co. retains the right to display completed work in our portfolio and marketing materials
• Drafts, unused concepts, and working files remain our property unless otherwise agreed

7. Website Projects

For website design projects:

• You are responsible for:
  
  • Domain and hosting accounts (unless otherwise agreed)
  • Ongoing maintenance after project completion
• We are not liable for:
  
  • Third-party platform issues (e.g., hosting outages, plugin conflicts)
  • Security breaches after handoff

8. Cancellations & Refunds

• Deposits are non-refundable once work has begun
• If a project is cancelled:
  
  • You will be invoiced for all work completed up to that point

9. Limitation of Liability

We are not liable for:

• Loss of revenue, profits, or business opportunities
• Any indirect or consequential damages

Our total liability is limited to the amount paid for the specific service.

10. Confidentiality

Any sensitive information shared during a project will be kept confidential and not disclosed to third parties.

11. Governing Law

These Terms are governed by the laws of Alberta, Canada.

12. Changes to Terms

We may update these Terms at any time. Continued use of our website or services constitutes acceptance of those changes.
